Welcome and thank you for visiting the ATEN website (“Website”) and reviewing our Terms & Conditions of Use (“Terms of Use”). ATEN, LLC, its subsidiaries, including ATEN, LLC, hereinafter collectively referred to as “ATEN”, make this Website, including all information, documents, catalogs, communications, files, text, graphics, and audio/visual files (collectively, the “Materials”) available for your use subject to the Terms of Use set forth in this document. It spells out what you can expect from us and what we expect from you.
For the purposes of this Agreement, "Confidential Information" refers to any information disclosed by Attendee that is not publicly available and is of a confidential or proprietary nature. This includes, but is not limited to, personal information, health details, conversations, activities, or any other information disclosed during the wellness retreat.
Recipient agrees to maintain the confidentiality of all Confidential Information disclosed during the wellness retreat. Recipient shall not disclose, directly or indirectly, any Confidential Information to any third party without the prior written consent of Attendee.
Recipient agrees to use the Confidential Information solely for the purpose of participating in the wellness retreat and shall not use such information for any other purpose without the explicit consent of Attendee.
Confidential Information does not include information that: (a) is or becomes public knowledge through no fault of Recipient; (b) was rightfully known or becomes known to Recipient without confidential or proprietary restrictions; (c) is independently developed by Recipient without the use of any Confidential Information; or (d) is required to be disclosed by law, regulation, or court order, provided that Recipient provides prior notice to Attendee to allow Attendee to seek a protective order or other appropriate remedy.
The obligations of confidentiality under this Agreement shall remain in effect indefinitely from the date of disclosure of the Confidential Information.
This Agreement constitutes the entire understanding between the parties concerning the subject matter hereof and supersedes all prior agreements, whether written or oral. Any modification or amendment to this Agreement must be in writing and signed by both parties.
